Berekum Chelsea have leapt from the bottom of the FCPPL log to fifth place after winning points docking appeal.
A Ghana FA Disciplinary Committee (DC) ruling last month declared Chelsea losers of their league matches after February 4 for their failure to meet an ultimatum given the club in paying West Africa Football Academy (WAFA SC) its share of monies - $59,722.23 - received in respect of the transfer of Solomon Asante to TP Mazembe.
That ruling saw Chelsea lose as many as 18 points while clubs like Great Olympics, Medeama SC, Bechem United, Liberty Professionals, Asante Kotoko and New Edubiase who played against Chelsea from match days 5 to 10, were awarded full points and three goals in their encounters with the one-time Ghanaian champions. They were to lose further matches until they settled their indebtedness to WAFA.
Berekum Chelsea filed an appeal against the ruling arguing that they had privately agreed payment terms with WAFA in respect of their indebtedness and so, have been wrongly treated.
Their appeal has now been upheld by the Ghana FA Appeals Committee.
Asante Kotoko, who first petitioned the Disciplinary committee over the matter shockingly presented their protest under a repealed Ghana FA Regulation – Article 34(1)(L). The Disciplinary Committee accordingly dismissed their protest.
On that grounds, the Appeals Committee is of the “considered view that the DC having expressly decided that the protest failed in this respect ought to have dismissed the protest because it lacked the requisite jurisdiction to deal with the merits of the protest. Indeed, the DC acted ultra vires its powers or mandate in proceeding to determine the matter on its merits when it had ruled that the protest was not properly brought before it.”
“Consequently, it is our opinion that the determination of the matter on its merits and the consequential orders made by the DC were a nullity and we hereby so declare.
“Accordingly, the appeal succeeds and the decision of the DC is hereby set aside,” parts of the ruling read.
Implications
All clubs like Great Olympics, Medeama SC, Bechem United, Liberty Professionals, Asante Kotoko and New Edubiase who benefited as a result of the initial Disciplinary Committee ruling have had those point deducted.
- Berekum Chelsea regain all their points lost from the boardroom and now move to fifth position with 19 points after 13 games.
- Medeama SC relinquish the third position to WAFA as they drop to seventh with 19 points.
- Defending Champions Asante Kotoko move down the lad having lost the two points gained to eighth position.
- Liberty Professionals are now 10th on the log with 10 points just like Asante Kotoko and Hearts of Oak who lie above them.
- Great Olympics dangerously beat the relegation drop on better goals as they share 16 points with Bechem United and New Edubiase United who occupy the 14th and 15th positions respectively. BA United move bottom with 10 points after 13 games.
The FCPPL returns with match day 14 fixtures on April 25.
